Terms of service

This agreement governs your use of EightyStar. It is free to use and still being built. What you put in belongs to you. Because it is beta software provided at no cost, it comes with no guarantees - including no guarantee that your information will not be lost. Please read it before you rely on EightyStar for anything that matters.

1. Agreement to these terms

In short: Using EightyStar means accepting these terms. If you do not accept them, do not use it.

These terms of service constitute a legally binding agreement between you, whether personally or on behalf of the members of your family space (“you”), and EightyStar (“we”, “us” or “our”), concerning your access to and use of the EightyStar website and application (the “Services”).

By creating an account or otherwise using the Services, you agree that you have read, understood and accepted these terms. If you do not agree, you must not use the Services. They apply alongside the privacy notice, which is incorporated here by reference.

2. Who may use EightyStar

In short: You must be 13 or older to sign yourself up. A parent may set up a sign-in for their own child under 13 and remains responsible for it.

By using the Services you represent that you are at least 13 years of age, that you have the legal capacity to enter into this agreement, and that you will comply with it.

Children under 13. Nobody under 13 may create an account for themselves, and no invite link is offered to one. A parent or guardian may set up a sign-in for their own child under 13 from inside the app, using an email address the parent creates and controls. In doing so, that parent accepts these terms on the child’s behalf, consents to the processing described in the privacy notice, and remains responsible for the account and for what is recorded about the child.

A child may appear in a family space - on the calendar, in reminders - without any account at all, which requires nothing from them.

3. Your account

In short: One person, one account. Look after your password and your device, and give us an email address that reaches you.

  • Accurate information. Give a real email address. It is how you get back in, and how you would be told about anything serious.
  • One person, one account. Do not share credentials with anyone.
  • Your password and your device are yours to look after. Anyone who can unlock a device where you chose “keep me signed in” can open your family space without a password. That is deliberate, for shared family tablets, and it is why it is off unless you choose it.
  • Tell us if something is wrong. If you believe your account has been accessed without your permission, change your password and contact us.

You are responsible for all activity under your account. We may suspend or remove an account as described in section 14.

4. Free forever

In short: The core of EightyStar is free, with no subscription and no card. That is a commitment, not a trial.

The dashboard, the Family Inbox, the calendar, your people, your lists and your family’s records are free. If a paid tier ever exists it will be for something additional, and what is free today stays free.

Free also means no advertising and nothing sold. There is no hidden way in which this is being paid for by you.

5. Sparks and rewards

In short: Sparks are a scorekeeping feature inside your family space. They are not money, they are worth nothing outside your household, and they can never be exchanged for cash or anything else from us.

EightyStar includes a feature in which members of a family space earn “sparks” for completing tasks and may redeem them against rewards that your family has written itself. Both the sparks and the rewards exist only inside your family space and only for as long as it does.

Sparks have no monetary value. They are not money, currency, electronic money, stored value, a gift card, a security, a financial instrument, a crypto-asset or property of any kind. They are a number we calculate from your family’s own records and display back to you. In particular:

  • They cannot be exchanged, redeemed, cashed out or refunded for money, goods or services from us, and we will never do so.
  • They cannot be bought. There is nothing to purchase, no top-up, and no circumstance in which we will ask you for payment for sparks.
  • They cannot be sold, traded, gifted, transferred or moved outside your family space, including to another family space or to any other person or platform.
  • They are not earnings, wages, an allowance, pocket money or compensation for work, and nothing in this feature creates an employment or contractual relationship between members of your household.
  • They confer no ownership, credit, entitlement or claim of any kind against us.
Please do not treat sparks as money or use them as if they were. They are a way for a family to keep score with each other and nothing more.

Rewards are promises between you, not by us. The things sparks are spent on are written by members of your own family, for members of your own family. When somebody redeems one, EightyStar records that they asked for it. We do not provide, fulfil, guarantee, mediate or take any responsibility for whether it actually happens. That is entirely between the people in your household.

Balances are calculated, not held. A balance is counted from the tasks and redemptions recorded in your family space each time it is shown. If those underlying records are edited, dismissed or deleted — by anyone in your family space, or by you deleting your account — the balance changes accordingly. We may also correct, reset, suspend, change or withdraw the sparks feature, the amounts involved, or any part of it, at any time and without notice, as described in section 6.

Nothing is owed to you if sparks are lost, reduced or removed for any reason, including where a family space is deleted, where records are changed by another member of your household, or where the feature is withdrawn. No compensation of any kind will be paid.

Calls. The Services include an optional feature in which members of a family space put sparks on the outcome of a question they have written themselves, and whoever was right receives the sparks the others put in. It is switched off unless the person who created the family space turns it on, and then only for the members they name. No money is involved at any point: sparks cannot be bought, sold or exchanged for anything outside your family space, nothing of value is staked, nothing of value is won, and no stake or prize can be converted into money or goods from us. Nothing may be staked that has not already been earned inside the Services, there is no credit, and no member can end up owing sparks. This feature is a game between members of one household and is not a lottery, betting, gaming or gambling service of any kind.

Children. This feature is designed to be used by children within their own family. A parent or guardian is responsible for how it is used in their household, including what rewards are offered, whether they are honoured, and whether Calls is switched on at all.

6. Beta software

EightyStar is unfinished. Features change, things break, and your information could be lost. Do not let it be the only place something important is written down.

This is not a formality. The Services are provided on a pre-release basis and may contain errors, may be changed or withdrawn without notice, and may not operate continuously. Keep anything you cannot afford to lose somewhere else as well - the school form deadline, the flight reference, the appointment time.

We may add, change, suspend or discontinue any part of the Services at any time. Where a change is material we will make it visible in the app rather than announcing it only here.

7. Family spaces

In short: Everything in a family space is visible to everyone in it. Only invite people you would show all of it to.

Whoever creates a family space administers it. Inviting someone gives them sight of everything in that space, now and in the future - there are no private items within a space.

Adding a person as a member, including a child, means taking responsibility for the information you record about them, and confirming you are entitled to record it.

Ownership of a space can be handed to another adult in it at any time, from their name on the Your people page. The previous owner remains a member as an adult.

8. Your content

In short: What you put in belongs to you. We take only the permission needed to run the service for you.

You retain ownership of your content. We claim no ownership of anything you add. You grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce and display your content solely to the extent necessary to operate the Services for you and your family space - and, where your family has turned that on, to transmit it to the AI service provider so it can be read.

This licence exists only to run the product. It ends when you delete the content or your account. Your content is never used to train models and never sold. It is never shown to another family, and the only party outside EightyStar that ever processes it is the AI service described in the privacy notice, and then only while your family has turned that on.

You are responsible for what you put in, including having the right to put it there, and for ensuring it does not infringe anyone else’s rights.

9. Our intellectual property

In short: The software, design and name are ours. Your use of the Services does not transfer them to you, and the logo is not yours to use without asking.

The Services, including their software, design, text, graphics and the EightyStar name and marks, are owned by us or licensed to us and are protected by intellectual property law. Subject to these terms, you are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Services for your own family’s personal, non-commercial use.

Except as permitted by law, you may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from any part of the Services, nor remove any proprietary notices.

Our name and logo

The name EightyStar, the EightyStar logo, the eight-pointed mark and the wordmark are our trademarks, whether or not they are registered. Nothing in these terms gives you a licence to use them, and using them without our prior written permission is not allowed.

Without that permission, you must not:

  • use the logo or mark in or on any product, service, application, website, packaging or printed material;
  • use them in a way that suggests we endorse, sponsor, supply or are connected with you or anything you offer, when we are not;
  • use them, or anything confusingly similar to them, as or within your own name, logo, app icon, domain name, social media handle or account picture;
  • alter, recolour, redraw, crop, animate or combine them with other elements, or present them as your own work;
  • register them, or anything confusingly similar, as a trademark anywhere.

You do not need permission to refer to EightyStar by name in ordinary writing — in a review, an article, a comparison, a support forum, or a link to our site — so long as what you say is accurate and does not imply a relationship that does not exist. Honest reference is not the thing this clause is about.

If you would like to use the logo for something, ask us at privacy@eightystar.com and tell us what you have in mind. Permission, if we give it, is limited to what we agree to, must follow any guidance we provide, and may be withdrawn at any time — at which point you will need to stop using it within a reasonable period.

10. Acceptable use

In short: Do not break the law with it, do not attack it, and do not use it to hold information about someone who would object.

You agree not to use EightyStar to:

  • break the law, or help anyone else do so;
  • store or share material that is illegal, or that abuses or endangers anyone;
  • hold information about another person that they have not agreed to and would object to;
  • attack, overload, probe or disrupt the Services, or attempt to reach another family’s space or any account that is not yours;
  • circumvent, disable or interfere with any security or access-control feature;
  • use any automated system to access the Services in a way that sends more requests than a person reasonably could;
  • resell the Services, or run them as a service for others, without a separate written arrangement.

Security research is welcome. If you find a vulnerability, report it to privacy@eightystar.com rather than exploiting it, give us a reasonable opportunity to fix it, and you will be thanked rather than pursued.

11. Connected accounts and third-party services

In short: Connections are read-only, can be disconnected at any time, and depend on services outside our control.

Connecting an account such as Google Calendar grants EightyStar read-only access to what you select. EightyStar never writes to a connected account.

Those services are operated by third parties under their own terms and privacy policies. A change on their side can stop a connection working, and their availability is outside our control. We are not responsible for third-party services, and linking to or integrating with one is not an endorsement of it.

You may disconnect at any time from the Connections page, which deletes the stored tokens.

12. Notifications

In short: Notifications are off until you turn them on, and are never guaranteed to arrive.

EightyStar can send a daily brief and occasional reminders to devices where you have granted permission. You may turn them off at any time in Settings, or revoke permission in your browser.

Delivery depends on your browser, your device, your network and push services operated by others. We do not guarantee that any notification will arrive, arrive on time, or arrive at all, and you should not rely on one for anything with a consequence.

Separately from notifications, we may send you service messages necessary for the administration of your account, such as security or account notices. These are not marketing and cannot be switched off while you hold an account.

13. Privacy

In short: How we handle your information is set out in the privacy notice, which forms part of this agreement.

Please read the privacy notice. It describes what is collected, how it is used, who it is shared with, and the rights you have over it. Where processing depends on your consent - such as letting an AI service read what you put in - you may give or withdraw that consent at any time from Your choices in the app.

14. Ending this agreement

In short: You can leave at any time, and deleting your account is immediate. We may suspend an account for breaking these terms.

Ending it yourself. Stop using EightyStar whenever you like. To delete your account, open Settings and use “Delete your account”. It takes effect immediately and cannot be undone.

If you own the family space, deleting your account deletes the space and everything in it, for everyone in it. You will be shown exactly what that means before confirming, and offered the option of handing the space to another adult instead - do that first if the rest of the family still needs it. If you are unsure, email privacy@eightystar.com before you confirm rather than afterwards.

Suspension and removal by us. We may suspend or remove an account for breaching section 10, or where required by law. Except where something illegal or harmful is involved, you will be told why and given a reasonable chance to get your information out. Suspension is reversible; if you believe it was a mistake, contact us.

Discontinuation. The Services could be discontinued. If that happens you will be given reasonable notice and a way to export what is yours.

Sections 7, 8, 14, 15, 16, 17 and 18 survive the end of this agreement.

15. Warranty

In short: EightyStar is provided “as is”. There is no promised uptime and no guaranteed backup.

EightyStar is provided “as is”, with no warranties of any kind, express or implied - including fitness for a particular purpose and uninterrupted or error-free operation.

There is no promised uptime, no guaranteed backup, and no guarantee that a reminder or notification will arrive. Notifications depend on your browser, your device and services outside this one.

Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you. Nothing here affects rights you have as a consumer that cannot be excluded by law.

16. Limitation of liability

In short: Since the service is free, any liability that does apply is limited to what you have paid, which is nothing.

To the fullest extent the law allows, we accept no liability for indirect, incidental, special, consequential or punitive loss arising from your use of or inability to use EightyStar - including missed appointments, missed deadlines, lost information, or loss of profits, revenue or goodwill.

Since the Services are provided free of charge, any liability that does apply is limited to the total amount you have paid us for them, which is nothing.

Nothing in these terms limits or excludes liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited.

17. Indemnification

In short: If your use of EightyStar causes a claim against us, you agree to cover it.

You agree to indemnify and hold us harmless from any claim, demand, loss or reasonable expense arising out of your breach of these terms, your misuse of the Services, your content, or your violation of the rights of another person. We will notify you of any such claim and you may participate in its defence; you may not settle a claim in a way that imposes an obligation on us without our written agreement.

18. Governing law and disputes

In short: Most things are settled by an email. Where they are not, this says which law applies.

These terms are governed by the law of the place where EightyStar is operated. If a dispute arises, the sensible first step is to email the address below - most things are settled that way.

Before starting any formal proceedings, please contact us at privacy@eightystar.com and give us a reasonable opportunity to resolve the matter. The great majority of disputes are settled that way, and it is faster for everyone.

Nothing here deprives you of the protection of mandatory consumer law in the country where you live, or of the right to bring proceedings in your local courts where that right cannot be excluded.

19. General terms

  • Severability. If any provision is found unenforceable, it is severed and the rest remains in force.
  • No waiver. If we do not enforce a provision, that is not a waiver of our right to enforce it later.
  • Assignment. You may not transfer your rights under this agreement. We may transfer ours in connection with a merger, acquisition or sale of assets, and the privacy notice explains what that would mean for your information.
  • Entire agreement. These terms and the privacy notice are the whole agreement between us about the Services, and replace any earlier version.
  • Events outside our control. We are not liable for failure to perform caused by something beyond our reasonable control, including network, hosting or provider failures.
  • Electronic communications. You agree that we may communicate with you electronically, and that electronic notices and records satisfy any legal requirement that such communications be in writing.
  • Headings. Section headings are for convenience and do not affect interpretation.

20. Changes to these terms

In short: Yes, these will change as the product does.

We may update these terms from time to time. The date at the top changes with them, and a material change will be made visible in the app rather than announced only here. Continuing to use EightyStar after a change takes effect means you accept it. If you do not accept a change, stop using the Services and delete your account.

21. How can you contact us?

For anything at all about these terms, or about EightyStar generally, email privacy@eightystar.com.
